Rehiring Former Employees

If you need to rehire a former employee, please reach out to your dedicated Customer Success Manager or our Admin Support team. You will not be able to reactivate a terminated employee’s profile from your admin account. Please do not enter a former employee as a new hire with a different email address. 

Once the rehire is processed by the Customer Success team, the employee may receive a new enrollment period and a new benefits start date depending on the amount of time they were unemployed by the company. The Affordable Care Act's (ACA) Rule of Parity requires that any employee with a break in service of less than 13 weeks have an offer of coverage without a typical new hire waiting period. More details below. 

Scenario A

A terminated employee is rehired more than 13 weeks from their date of separation. 

Result: The employee is subject to the new hire waiting period.

Scenario B

A terminated employee, who had previously elected coverage, is rehired between 1 and 30 days from their date of separation.

Result: An offer of coverage is extended to the employee upon rehire. The employee is not subject to the new hire waiting period and coverage should begin on the date of rehire. The member can choose to stay on the same plan previously elected or change their plan selection.

Scenario C

A terminated employee, who had previously elected coverage, is rehired between 31 days and 13 weeks from their date of separation. 

Result: An offer of coverage is extended to the employee upon rehire. The employee is not subject to the new hire waiting period and coverage should begin on the first of the month following rehire. The member can choose to stay in the same plan previously elected or change their plan selection.

Scenario D

A terminated employee, who had previously waived coverage, is rehired within 13 weeks from their date of separation.

Result: An offer of coverage is extended to the employee upon rehire, but they are subject to the new hire waiting period if they elect coverage.
